Terms of Service

You are responsible for the activity on your account and for keeping your credentials secure. Notify us immediately if you suspect unauthorized access. We may suspend accounts that violate these terms or applicable law.

You own the health data you upload or sync (lab results, doctor's notes, wearable streams, etc.). You grant WellTraces a limited license to process that data solely to operate the service for you — generate insights, render charts, and respond in chat. We do not sell your data. See our Privacy & Security page for details, including encryption, retention, and export/delete rights.

Eva and the other AI features use large language models to surface patterns in your data. Doing so sends the relevant parts of your record to a third-party AI provider for processing — see the Privacy & Security page. These models can be incomplete, outdated, or confidently wrong, and they have not been clinically validated. Treat every output as a prompt to ask a better question, never as an answer. Verify anything important with a clinician before acting on it.

When you connect a wearable, lab, or provider integration (e.g., Oura, Apple Health), you authorize WellTraces to access that data on your behalf. Those services are governed by their own terms and privacy policies. We are not responsible for outages or changes in third-party APIs.

You agree not to (a) upload data you don't have rights to, (b) use the service to provide medical advice to others, (c) rely on it to make a health or treatment decision without confirming with a qualified clinician, (d) attempt to access other users' data, (e) probe, scan, or test the vulnerability of our systems without permission, or (f) use the service to violate any law.

WellTraces does not currently charge for access. If paid plans are introduced, these terms apply: paid plans renew automatically until canceled. You can cancel anytime; access continues through the end of the current billing period. Prices may change with notice. Refunds are handled on a case-by-case basis under applicable consumer law.

You are responsible for how you use what WellTraces shows you, including any decision to seek, delay, or stop care. WellTraces does not practise medicine and cannot know your full clinical picture — it only sees what you have given it, which may be incomplete or out of date. If information here conflicts with your clinician, follow your clinician.

The service is provided "as is" and "as available." To the maximum extent permitted by law, WellTraces disclaims all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI output will be accurate.

To the fullest extent permitted by law, WellTraces and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or health outcomes arising out of your use of the service. Our total aggregate liability for all claims is limited to the greater of (a) amounts you paid us in the 12 months prior to the claim, or (b) USD $100 — and during the free test period, no fees are paid, so this cap applies in full.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, and nothing in these terms limits liability for gross negligence, willful misconduct, fraud, or death or personal injury caused by our negligence, where the law does not permit that limitation. In those cases our liability is limited to the least the law allows.

You may stop using WellTraces and delete your account at any time from your profile. We may suspend or terminate accounts for violations of these terms. Upon termination, your data is deleted per our retention policy unless retention is required by law.

We may update these terms as the product evolves. Material changes will be communicated in-app or by email. Continued use after the effective date constitutes acceptance.

These terms are governed by the laws of the jurisdiction in which WellTraces is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection law provides otherwise.
